Supreme Court Upholds Health Care Law; Do You Support the Ruling?

High court finds the individual mandate in "Obamacare" is constitutional in a 5-4 decision.

The Supreme Court on Thursday upheld President Barack Obama's health care reform law in a 5-4 ruling, sending the president into the November election with a major victory under his belt.

The heart of the issue surrounds the individual mandate clause, which required Americans to buy health care coverage or face penalties.

The justices ruled that mandate fell within Congress' power to collect taxes, and is therefore constitutional.

Justices John Roberts, Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor and Elena Kagan wrote the majority opinion.

The decision in Florida v. Department of Health and Human Services comes as something of a surprise after the generally hostile reception the law received during the six hours of oral arguments held over three days in March. But by siding with the court's four Democratic appointees, Chief Justice Roberts avoided the delegitimizing taint of politics that surrounds a party-line vote while passing Obamacare's fate back to the elected branches. GOP candidates and incumbents will surely spend the rest of the 2012 campaign season running against the Supreme Court and for repeal of the law.

I'm curious about a few things
1. How many of you think President Obama is a Muslim? And why? And if you do, why do you think he regularly goes to church? 2. Why does that matter to you? 3. Do you believe that the healthcare law adds death panels? Where is that in the law? What does it actually say? 4. Do you believe that health insurance companies don't already have death panels? 5. Do you have Medicare? Who do you believe provides Medicare? 6. Do you have health insurance? If you don't, how do you pay for hospitals doctors and labs? 7. Did you know that the US spends 50% more per capita on health care yet a far lower percentage of the population has health coverage then most countries with so callled socialized medicine?

pbug56 Please let all of us know how you made out with your doctor. Have you made an appt. with the Stony Brook Dental School. Investigated their Dept. of Opthomology? Pardon the misspellings. Most of the people here dissenting and woeing that the Affordable Health Care bill passed, have no idea what it will mean to them until they get sick and have to use it.

Everyone has a right to be heard, in their own words, as long as they are not being nasty. We all need health insurance and let's hope you never encounter a major medical bill that you can't pay. My recent stay in the hospital was over seventy five thousand for a week and the ambulance ride cost $1800. We have medicare and a supplementary plan so let's see what I have to pay myself before the plan gets under way. Supposedly with more people being insured, the cost will be less. It's hard to believe that some people don't have any insurance, because of losing a job, having pre existing condiitons. Take politics out of the whole thing. Mr. Romney's plan and this plan are just about the same. It's just called Romney Care and I think the people in Massachusetts likes it.

Den, I agree. LET'S ALL PAY 91% of our income!!!! If you earn a hundred dollars a week, you pay $91 and if I earn a thousand, I will pay $910 .........THAT'S FAIR! I AGREE!!!
do you even have a clue as to the PERCENTAGE of the wealthier people, and corporations income that go to taxes? It's pretty embarrassing to those who unfortunately do not earn as much due to "luck"? or lack of education or just aren't willing to work as hard or risk as much? to earn more. This Country was built on FREEDOM and OPPORTUNITY. I put MYSELF through the education process with no HANDOUTS and paid back every dime of student loans. I also put up every cent I had and risked everything I had to start a business, Do you really believe that I should have to pay over 65% RIGHT now of my income so someone who didn't work as hard or risk as much as I, can kick back and collect from the SYSTEM? while they pay 20% of their income and constantly have their hand out?

The sick, elderly, handicapped etc have every right and deserve every penny afforded to them by the 'system' but let's face reality there are plenty who consider themselves 'deprived' but are just too lazy to work harder and earn it! Enough with the entitlements!!! Take a look at who's on those lines of entitlements! I struggled to pay student loans......the students of today think they should just be wiped clean and everyone else should pay their way! If someone is sick today and they go to a state hospital they will not be turned away. It's a fallacy if you believe people are being left to die in the street with the current system. Most of the people who are clambering for bigger government and 'more control' of government simply want more for nothing. There's an old saying... "God helps those who help themselves"... let's quit the hand out attitude and work together on a fair plane......and by the way, keep putting ALL of the burden on the small businesses and corporations and they will take their earnings and call it a day. The unemployment will skyrocket more than it already is! The "numbers" they are giving you are totally incorrect! The unemployment numbers under this administration are astronomical! Try adding in those who can no longer 'collect' unemployment checks because their time expired to those who are now 'listed' You will have a better handle on what's going on in this country.

Marion, you are right. Most American's are not looking at whether someone is a different 'race' ! That has nothing to do with politics and policies. You were very fortunate to have met Rosa Parks. She was a very special and strong woman who had convictions and beliefs and worked very hard for them. Women of all races benefited from her strength.

For those who think that the unemployed are all lazy, know this about me;
1. In 2 plus years out, I've applied for over 500 jobs. Most recruiters have made it very clear their firms won't hire the unemployed. 2. I've gone after any and all training to make my hard earned IT skills more relevent today. I is still made clear to me that employers only hire people currently working hose work skills are a 100% match to their needs. 3. In my line of work, IT bosses scream they can't get talent. What they can't get is minimum wage talent for very hi tech skills. This is their excuse for shipping huge numbers of jobs off to Bangalore, Mumbai and Manila, and for going after every H1B visa they can get. 4. Property taxes out here on Long Island are obscenely high. Add to that health insurance that costs more here then anywhere else in the world. Specifically, costs for individuals to buy on their own. An employer could ensure me for $3-400 a month, but for me to get the same coverage costs over $1300 a month. Add to that my T1 diabetic daughter, etc. At the same price - at least. I'm not lazy, I actually had decent savings once just in case, and when I was still employed worked 60 plus hour weeks with no overtime pay because my employers wouldn't hire enough staff to carry the work load. And add those hours to what was 4 hours a day commuting on the Long Island Snail road. No, I'm not lazy, I'd go back to that hell in an instant just to be able to support my family.

Australia: Population 22 million Switzerland: Population 7.6 million USA: Population 315 million California: Population 38 million Which country do you think has more freeloaders? Do I need to discuss the immigration issues or is it painfully obvious that every other country is in immigration lockdown mode except the US (or completely surrounded by water)? So in short it's much easier to implement national healthcare to a relativly small population along with the least amount of freeloaders. The US government encourages it's citizens to abuse entitlements as well as having a very lax immigration system. Obamacare is doomed to fail before it even starts because the government doesn't know how to say NO to the abusers.

BTW, I actually support it, at least until we get all age Medicare finally. As to robkoz, most of the Western world has some form of 'romneycare'. And funny thing, healthcare costs far less per capita in all those countries then it does here. And funnier yet, if you go to one of these countries and get sick, they'll take good care of you, and probably not charge you anything. Even Cuba! The reason is simple; we put so much of our healthcare money into making insurance company bosses and stockholders rich. Plus drug companies, and lately many hospitals. In most other countries, they are single payor, sometimes public doctors, sometimes not. But healthcare is decent in many and costs the countries far less and makes them more competitive in world markets.

@ pbug56, I'm sure it would work here IF so many BILLIONS weren't spent on entitlements. I just looked up some of the stats on how many are on food stamps, welfare, etc. and the number of people in the USA on some sort of government assistance is more than almost all the countries in the EU and Australia. It's really sad what the government has created and now they want the hard working taxpayers to foot the bill for this nonsense. Sorry but it's time for people that don't contribute to step up or just GTFO!

You know what, pbug, you're begginning to sound better. I think just interacting with all these "commentators" whether you're for or against their comments has helped you deal with your many health concerns. You see that so many here care about your situation. I hope you go to Stony Brook and make use of their opthomology dept. and of their Dental school. And maybe you can talk to the doctor who did the cornea operation and you might find him being helpful after all. I have seen so many front office people in doctors offices that don't represent the doctor they work for.

Yes Vec... and are you aware that with obamacare the elderly will be left to die rather than to be given the opportunity for transplants etc?
I seriously doubt that ALL conservatives want to see everyone dead. You really need to try to see both sides of the issues and not be so closed minded and blinded by anger

Den... perhaps you should follow your own advice and stop thinking you are speaking the views of "all people" of the United States. Perhaps you should move to a country where the government controls everything if you think that's the correct solution. I believe this Country was built on FREEDOM and not socialism.... and I and many others are not interested in being led like sheep into a bigger mess than we have. Our ancestors and recent troops have given the ultimate sacrifice to keep this country free and allow us to make choices and have opportunity! If you like the way the "other" countries are run, PLEASE, move there and enjoy that way of life.
You should also check your facts about the percentages of taxes some millionaires are paying before you mouth off... You might learn something.

Admittedly, the idea of a low-cost, universal health care system that covers everyone is arguably a noble goal. That's the vision that was sold to the American people with Obamacare: lowers insurance costs, no new taxes, freedom to choose, and total transparency. What we got instead was a law written largely by insurance companies and health care interests which raised health insurance costs, monopolized the health care system, introduced trillions in new taxes, limited freedom of choice and has been steeped in secret government deals with "sick care" corporate interests. Obamacare, in other words, has become the Great Swindle. The funny thing about the argument against the "expansion of healthcare coverage" is that you have all these people that have no idea what they are talking about. Fox News is not a source of fact or truth. I guarantee every person writing on this topic is not a 1 %er. Folks - you've been duped and are fighting battles to maintain the disparity of wealth in this country. Do you think that your needs, values, and principles are in close alignment with people that have a net worth of $10m or more. I think you've been suckered. Think about how expanded healthcare might benefit your neighbors, parents, children, etc. Then, think about people a few towns away that are less fortunate. You are not losing money on this plan. You pay for it either way. (And P.S. if Justice Roberts becomes the swing vote and says it's not unconstitutional, then I believe him.)

I'm amazed at some of the pure nonsense posted here. True enough, Fox LiesChannel wouldn't know the truth if it bit them in the butt. What I don't understand is how, in an area where most people have at least some education, that the BIG LIE nonsense is so frequently believed. A few days ago, a woman told me that she believed that 'obamacare' still included death panels. Not that it ever did, of course. The non-distorted truth was that someone elderly, or perhaps with a long term fatal illness, could choose to go to their doctor and get counseling and advice - and the doctor would be paid for the visit. Then there's the massive tax I keep hearing about. The tax is just for people who can afford health insurance, perhaps from their employer, but chooses not to get it. And the amount is a lot less then what insurance costs, and those funds go to help pay the cost when idiots like this have an emergency and end up in the hospital.
The law is not perfect. It does enrich insurance companies to a point, yet finally makes them spend most of what they take in on - get this - health care. Some people will get insurance rebates soon - if their insurer was putting too much of their premiums into things like executive pay. No, what there should be is Medicare for all, and yes, there would be a cost for it. But overall, Americans pay far more for health care then do people in any other western country. That must change!

To Rez; obviously you haven't read any of this. The US currently pays 50% more per capita for health care then other western countries that already have universal health care. Yes, there are costs here. Some of the cost for covering the uninsured will be paid for by the 'penalty'. But under this law insurance companies now have to use a much higher percentage of revenue for - get this - actual health care. That will help. And there are a lot of other things that have to happen. Once hospitals see that every patient will be covered (eventually), they can change their absurd price structures. But until we go to single payor (ie Medicare for all) we will still pay far more for medical costs then other countries do. Until drug companies can no longer badly overcharge (in Canada, drugs made in the US cost far less then they do when sold in the US).
As to no more middle class, the Dubya tax cuts were designed to make the rich far richer and to pretend to give a little to the middle class. But the Republican sanctioned destruction of unions, the huge layoffs of civil service workers, those and more are destroying the middle class now. Recently Romney said that even though many cops, firemen and teachers have lost their jobs, that far more needed to still lose their jobs, that we have way too many of them. Also, offshoring of decent US jobs is destroying the middle class. We, the middle class, are a dying group.

"This is the greatest loss of freedom in our lifetime...?" Its this type of hysterical purple prose that prevents rational debate in today's politics. This is not Soviet Russia, its not even Finland. This idea was the brain child of the Heritage Institute for Pete's sake! Look at "Romneycare" in Massachusetts or even Hawaii whose Universal Healthcare is even more "Socialist." The citizens of those states are pretty darn happy with their Healthcare from what I have read. So the government wants you to be a responsible citizen, if you choose to smoke, get lung cancer - the rest of us who don't smoke don't have to pay for all of your chemo - I'm fine with that, like I'm fine with the government telling me that if I drink and drive I go to jail. There are tons of stupid ideas from the Liberal side of the aisle (outlawing Soda?) - but this isn't one of them. No one should lose a loved one because they can't afford the care. If my tax dollars go to keeping some kids mother alive, I'm happy with that. I believe that's what living in a democracy is about.

For all of you mourning your supposed list of freedoms on today, Independence Day, a few thoughts;
1. Obamacare, correctly known as Romneycare, or NewtCare - it is a compilation of REPUBLICAN proposals over a number of years that Obama figured would help some and ought to pass since every single piece of it came from Republicans - who disavowed it the moment Obama supported it. 2. If there is one thing that Republicans are working on harder in much of the country then in defeating their own health care proposals, it is doing everything it can to cut back on the number of properly registered Latino and African American voters from actually casting their votes on Election Day in November. 3. If you have any confusion about who is paying to defeat Romneycare, push anti-voting initiatives, suppress women's reproductive rights; Google the Koch Brothers, and then move on from there to find their friends. 4. If you wonder whose side Mitt Romney is actually on in anything - that's easy - his. Remember - he said "I love to fire people". Remember - Bain Capital's claim to fame - save a few companies, squeeze the living daylights out of a bunch of others, offshore as many American jobs as possible, get even richer by having tax protected offshore accounts in the Cayman Islands. Are any of us in Commack rich enough to afford the lies and the attack on the middle class that he such a huge part of?

I know this idea sounds like Socialism/Communism/Totalitarianism to most conservatives, but we are supposed to be a UNITED States of America. You know, people who come together to form a more perfect UNION. To me, that implies that we work together and take care of each other to make our lives and our nation better. Unfortunately, we aren't Amish so not everyone is can lend a hand at the barn raising so we levy taxes, instead. There are many documented cases of people are denied Health Care in America, just google it. And frankly, how "Free" is someone who has a major health crisis and no health care? Do you really have control if you if need charity or fundraisers to help pay for health care?
