Cyberbullying and where does the school stand

my child was the victim of cyberbullying by another student in middle school. who made a false facebook page making a statement that my son is gay and used his photo.  made a police report but was told that is freedom of speech, contacted the vice prinicipal and all i got was sorry to hear that. no recourse for my son so when he took matters into his own hands and stood up to this person and confronted him for what he did a shoving match insued and my son was suspended is that justice. i would say not. if anyone has any advice would love to hear it.  also been struggling with facebook to have them take down that page what a nightmare that is.  loving the "old days"  more and more.. thanks for listening
